All Goods which appear on the Website are subject to availability.
4. Personal Information and Registration
We retain and use all information strictly under our Privacy Policy. We comply with the UK General Data Protection Regulation (UK GDPR) and Data Protection Act 2018.
5. Basis of Sale
The description of the Goods on our website does not constitute a contractual offer to sell the Goods. We reserve the right to reject any Order for any reason. A Contract will be formed for the sale of Goods ordered only when you receive an email from us confirming the Order (Order Confirmation).
6. Business & Trade Customers (B2B Provisions)
If you are registering and purchasing Goods as a Trade Customer (B2B account), you expressly agree to the following commercial terms:
- No Right to Cancel / Resi Trade: Trade Customers have no right to cancel or return Goods for change of mind. The statutory 14-day cooling-off period does NOT apply to commercial, business, or trade purchases. All sales of professional catering equipment, machinery, and commercial coffee supplies are final unless defective under warranty.
- Trade Payments: Payment terms for Trade Customers are agreed individually between the Supplier and the Customer at the time of account activation or order confirmation. Unless otherwise agreed in writing, all commercial orders are prepaid before dispatch. In cases where credit or deferred payment terms are approved, any late payments will incur interest under the UK Late Payment of Commercial Debts (Interest) Act 1998 from the due date until payment is received in full.
- Pricing & VAT: Prices displayed to Trade Customers are exclusive of VAT (Ex VAT). Applicable VAT at the current UK rate (20%) will be calculated and added at checkout.
- Commercial Product Warranty: In accordance with standard commercial practices, the Supplier provides a structural warranty on professional machinery. If any equipment is delivered defective or suffers a component failure during the specified warranty period, the Supplier is legally bound to service, repair, or facilitate the replacement of the defective parts under the manufacturer’s guidelines.
- Defect Reporting & Warranty Procedure: Any transit damage, shortages, or visible defects must be reported in writing to info@caffemilanoukltd.co.uk within 3 business days of delivery. Component failures during the warranty period must be reported immediately with photo/video evidence.
- What is NOT Covered: The commercial warranty strictly excludes: general wear and tear, damage caused by improper or unauthorized installation, unauthorized servicing, failure to perform manufacturer-required daily cleaning (such as group backflushing), use of incorrect water filtration, or damage due to limescale buildup (limescale voids all commercial machinery warranties).
- Improper Installation Disclaimer: The Supplier shall not be liable for any damage or breakdown caused by improper installation, unauthorized servicing, or use contrary to manufacturer guidelines. Professional machinery must be installed by a certified commercial engineer.
7. Price and Payment
The price of the Goods and any additional delivery or other charges is that set out on the Website at the date of the Order. Prices and charges for Consumers include VAT, whereas for Trade Customers they are shown Ex VAT until checkout.
8. Delivery
We will deliver the Goods to the Delivery Location without undue delay and, in any event, not more than 30 days after the day on which the Contract is entered into, unless a specific commercial installation date has been agreed in writing.
Professional Machinery Delivery: Professional espresso machinery and heavy catering equipment are delivered on pallets. It is the Trade Customer's responsibility to ensure adequate vehicle access, clear paths to the installation site, and the physical presence of the customer or an authorized representative to sign for and accept the delivery.
9. Risk and Title
Risk of damage to, or loss of, any Goods will pass to you when the Goods are delivered to you. You do not own the Goods until we have received payment in full.
10. Withdrawal and Cancellation (Consumers Only)
⚠️ NOTICE FOR COMMERCIAL ACCOUNTS: The Withdrawal, Returns, and 14-day Cancellation rights set out below apply strictly to Consumers (B2C) purchasing for personal use only. These rights do NOT extend to any purchases made via Trade or Business accounts.
You can withdraw the Order by telling us before the Contract is made, if you simply wish to change your mind and without giving us a reason, and without incurring any liability.
Consumers can cancel the Contract (except for any Goods which are made to your special requirements) by telling us no later than 14 calendar days from the day the Contract was entered into. The consumer must return the Goods in undamaged condition at their own expense. We will refund the payment without delay.
11. Conformity and Guarantee
We have a legal duty to supply the Goods in conformity with the Contract. For Consumers, this includes statutory rights under the Consumer Rights Act 2015. For Trade Customers, conformity and equipment support are governed strictly by Section 6 (Commercial Product Warranty) of these terms.
We will provide the following after-sales service: The supplier will support commercial customers in setting up, installing, and activating their equipment as part of our technical delivery contract.
12. Limitation of Liability
For Consumers: We are not liable for losses that were not foreseeable at the time the contract was made, business losses (including loss of trade or profits), or losses incurred by anyone who is not a consumer.
For Trade Customers / Businesses: The Supplier's total liability to any Trade Customer for any claim arising under or in connection with the Contract is strictly limited to the net invoice value of the Goods ordered. The Supplier shall under no circumstances be liable for any indirect loss, loss of business, loss of revenue, or loss of profits incurred by the business.
13. Force Majeure
The Supplier shall not be liable for any failure or delay in performing its obligations under the Contract where such failure or delay results from any cause that is beyond the reasonable control of that Party. Such causes include, but are not limited to: power failure, internet service provider failure, industrial action, civil unrest, fire, flood, storms, earthquakes, acts of terrorism, acts of war, governmental action, epidemic, pandemic, logistics or global shipping delays, or any other event that is beyond the control of the Party in question.

Alternative Dispute Resolution (ADR): If a dispute cannot be resolved directly, the parties may consider resolving it through an independent Alternative Dispute Resolution process before resorting to litigation.
